Privacy Policy Terms of Use

1. General provisions

1.1. This User Agreement (hereinafter — the “Agreement”) governs the use of the TEBYA•NET service (hereinafter — the “Service”) — the Android and Windows apps, the tebya.net website, and the Telegram bot @vpntebyanetbot, provided by the Administration.

1.2. By using the Service, including launching the bot, linking an account, paying for a subscription, or obtaining access to features, the User confirms that they have fully read the terms of this Agreement and accept them in full.

1.3. If the User disagrees with the terms of the Agreement, they must stop using the Service.

2. Nature of the services

2.1. The Service provides a digital service of an intangible nature — access to software for protecting network connection and privacy, including a free (Free) and a paid (Pro) plan.

2.2. The service may include:

  • access to a secure encrypted connection through the Service's servers;
  • selection of a connection profile, protocol, and server depending on the plan;
  • related features (statistics, diagnostics, split tunneling, and others).

2.3. The User understands and agrees that the value of the service lies in the provision and maintenance of infrastructure, connection stability, support, and updates, rather than in the exclusivity of individual technical components.

2.4. The Service does not claim or guarantee the availability of specific third-party resources — their availability is determined by third parties and the User's network.

3. Disclaimer of warranties and liability

3.1. The Service is provided on an “AS IS” basis.

3.2. The Administration does not guarantee:

  • that the Service will meet the User's expectations;
  • the achievement of any specific results;
  • uninterrupted and error-free operation of the Service or the constant availability of all servers and features.

3.3. The Administration is not liable for:

  • any direct or indirect damages, including lost profits;
  • the actions or inaction of third parties, telecom operators, and external services;
  • temporary technical failures and access restrictions.

3.4. All decisions on using the Service are made by the User independently and at their own risk.

4. Lawful use

4.1. The Service is intended to protect the User's privacy and connection security and is not intended to encourage, organise, or facilitate unlawful activity.

4.2. The User undertakes to use the Service solely within the framework of applicable law and the rules of third parties.

4.3. Responsibility for the lawfulness of using the Service lies entirely with the User.

5. Intellectual property

5.1. The software, design, and other materials of the Service are protected by intellectual property law.

5.2. The User is prohibited from copying, distributing, reselling, decompiling, transferring to third parties, or otherwise using the Service's materials without the rightholder's permission.

5.3. Violation of intellectual property rights may result in restriction of access to the Service without compensation.

6. Plans, payments, and refunds

6.1. The Service is provided under Free (free of charge) and Pro (paid subscription) plans. Current prices and periods are specified in the Service and on the website before the moment of payment.

6.2. Payment for the Pro subscription is made by available methods (bank card, SBP, cryptocurrency) through payment providers.

6.3. Due to the intangible nature of the digital service, refunds after access has been granted are not provided, except in the cases specified below.

6.4. A refund is possible only if:

  • the service was not rendered due to a technical fault of the Service;
  • access to the paid plan was in fact not granted.

6.5. To have a refund considered, the User must contact support within 24 hours of payment.

6.6. The decision on a refund is made by the Administration on an individual basis.

6.7. The User confirms that they undertake not to initiate a chargeback through payment systems without first contacting the Service's support.

7. Restriction of access

7.1. The Administration may suspend or restrict the User's access to the Service in the event of:

  • violation of the terms of this Agreement;
  • detection of abuse;
  • requirements of the law or payment providers.

7.2. Restriction of access does not release the User from obligations that arose earlier.

7.3. The Administration reserves the right to refuse service to Users whose actions may create increased risks for the Service, payment providers, or third parties.

8. Confidentiality

8.1. The processing of the User's data is governed by the Privacy Policy available at tebya.net/en/privacy.html.

8.2. The Administration collects the minimum necessary technical data and takes reasonable measures to protect it but does not guarantee the absolute security of the information transmitted.

9. Changes to the terms

9.1. The Administration may make changes to this Agreement.

9.2. The current version of the Agreement is published in the Service and on the website.

9.3. Continued use of the Service constitutes the User's agreement with the updated terms.

By using the Service (including launching the bot and/or entering the /start command), the User confirms that they have read this Agreement and accept its terms in full.
